Drug and Consumer Product Recalls

Corporations owe a moral and legal responsibility to the public to ensure that drugs and consumer products they manufacture are not unreasonably dangerous. Consumers must know the risks associated with ingesting a drug, using a powder or applying a patch or inserting a ring or suppository.  The US Supreme Court, agrees that the drug manufacturers, not the FDA, have the duty to warn consumers and patients of side effects and safety risks. Current dangerous products and drugs we are prosecuting include:

  • Talcum Powder Ovarian Cancer – $110 million, $72 million, $70 million and $55 million verdicts
  • Xarelto Bleeding – Bellwether Trials – Defense Verdict May 2017

Talcum Powder Ovarian Cancer

$110 million, $72 million, $70 million and $55 million verdicts

Verdicts ranging between $110 million to $55 million have been awarded by juries hearing evidence of women claiming genital use of Baby Powder and Shower to Shower caused their ovarian cancer. Cancer strikes nearly one in 70 women, though studies show that women who use talc-containing products (Baby Powder and Shower to Shower) on their genitals have a one in 50 chance of developing the disease. Trial experts have testified at least 45,000 women have died as a result of ovarian cancer that may be attributed to talcum powder use on the genitals, and estimate 1,500 women will die within the next year as a result of talc use.

Numerous talcum powder manufacturers changed to using cornstarch rather than talc after the American Cancer Society advocated for women to switch to cornstarch around the genital area in 1999. The plaintiffs advocate that talc particles can reach the ovaries and cause inflammation, while the defendant manufacturers allege there hasn’t been a large cohort study to prove a definitive cause and effect.
