Bard hernia mesh settlement success has been reached and could resolve most of the litigation if accepted by the majority of claimants. As with all settlements, the details are confidential and require a majority of the individual plaintiffs to participate. More than 21,000 separate design defect product liability lawsuits filed over the past six years involve plaintiffs that suffered painful injuries linked polypropylene hernia mesh products. Most of the injuries were caused by the Bard Ventralight, Bard Ventralex, Bard Perfix Plug, Bard 3D Max and other mesh products.
The cases have been centralized in multidistrict litigation before U.S. District Judge Sargus in the Southern District of Ohio since August 2018 in an MDL and consolidated in the state courts of Rhode Island, the home office of the manufacturer. Bard bellwether trials determine how juries analyze evidence and the jury verdicts provide a range of values to assist in resolving the remaining claims. The attorneys conferred with a mediator to settle the hernia mesh cases before the individual claims were remanded back to state courts for trials nationwide.
